總則
閣下安裝本程式(見下列定義)， 即表示閣下同意以下使用條款(程式條款)約束。閣下安裝和/或 接收本程式前，請先詳閱程式條款。

定義
本程式指由 Chop Stick Limited (下稱Chop Stick) 推出，提供“Chop Stick”服務並應用於運行 Android 或 iOS系統裝置上的應用程式，包括本程式的不時更新，以及所有令本程式可被使用的軟件或文件。

資料保護
閣下因使用本程式而向 Chop Stick 提供的任何個人資料，只會由 Chop Stick 根據私穩政策使用。有關政策已刊載於此網頁: http://chopstickapp.com/privacy

保護兒童
Chop Stick 的目標對象為及沒有計劃向18歲以下人士索取有關資訊，為保障未成年人士，凡未滿18歲之人士註冊前應先獲得你的家長或法定監護人的授權，並且必須確保他們同意你按照我們的條款及細則以及私隱政策成為ChopStick會員。Chop Stick要求未成年人士之家長或監護人監察有關人士瀏覽互網之情況。

專利權及授權
本程式內所有商標、版權、資料庫使用權及其他任何性質的知識產權，以至本程式的原始程式碼，均由 Chop Stick 直接持有。
Chop Stick 謹此授權閣下個人按照程式條款使用本程式。此權利為全球性、非獨有性、免付版稅及可被撤回。

使用條件
閣下不會進行，亦不容許第三者以閣下名義進行(i) 複製本程式並將副本加以分發；(ii) 試圖複製、重建、修改、修飾、進行逆向工程、分柝、反編碼、傳輸、交換或翻譯本程式；或(iii)製造本程式任何類型的衍生物品。
本程式目前僅供閣下個人免費使用，不得作商業用途。Chop Stick 保留權利隨時及以任何理由修改及撤回本程式，或就使用本程式或享用本程式所提供的服務，按程式條款規定向閣下收取費用。
閣下與流動網絡供應商所簽訂的合約條款，閣下同意於使用本程式時將繼續適用。因此，閣下在接通網絡使用本程式期間，或將被該流動網絡供應商收取網絡連接費用或其他第三方費用。閣下同意自行承擔此等費用。

取消服務及資料登記
Chop Stick 有權不事先通知你的情況下，暫停服務或其他任何部份，以作維修、保養、更新或其他 Chop Stick 認為適合的工作。
本程式所記錄閣下的個人資料如電話號碼和電郵地址，只會作身分確認或Chop Stick食商戶作推廣用途。

可用性
本程式適合於裝有 Android 或 iOS 系統的手持電話裝置上。Chop Stick 將合理地作出努力，讓本程式於任何時候均可使用。然而，閣下亦同意本程式乃經互聯網及移動網絡提供，其品質或可用性將受外界因素影響，而Chop Stick對此等因素未必能合理地控制。
當本程式無法使用、內容無法或難以下載或使用，或因通訊系統固障令本程式無法使用時，Chop Stick、其集團的公司、商戶、以至其承辦商，均不會承擔任責任。

系統要求
閣下必須擁有兼容及有上網功能的流動電話，並符合最基本的規格要求(軟件要求)，方能使用本程式。
該等軟件要求如下: 運行 Android 6.0 或以上 或 iOS 10 的流動電話。
該等軟件要求，或將不時升級，以支持新功能及新服務。

終止
Chop Stick 可隨時向閣下終止本程式的使用。

責任限制
閣下使用本程式而引起的一切直接、間接、特別、懲罰性、示範性或連帶性損失或賠償，包括利潤或相關損失，不論是否由任何一方蓄意造成，不論是否根據違反協議、侵權行為 (包括疏忽)、產品缺失或其他原因，Chop Stick 概不負責。
閣下如因安裝或使用本程式而導致設備遭受破壞或變更，包括但不限於電腦設備、手持裝置或流動電話，Chop Stick 概不負責。
程式條款內的任何規定，不能豁免或限制Chop Stick因疏忽、欺騙或欺詐性闡釋而引致的人員死亡或受傷而須負擔的責任，或在適合法律下不能豁免或限制的任何其他責任。

免責條款及保證
在法律最大程度的容許下，Chop Stick 謹此聲明並不承認有關本程式的所有默示保證。本程式及軟件以(原狀)及時(原樣)提供，不包括任何形式的保證。/span>

其他事項
協議闡釋:
條文的標題和例子僅供參考，以幫助用家操控及明白此等條款，並不構成條文的定義，或限制條文的適用範圍。
管轄法律:
此協議在任何情況下均受香港特別行政區法律管轄。
無效規定:
如本協議的任何規定被視為無效或不可執行，該規定應被移除，而餘下的規定將繼續生效。
未棄權:
若閣下或其也人士違反協議而我們並不追究，並不表示我們放棄追究嗣後或類似的違反協議行為。
轉讓:
我們有權轉讓本協議下我們的權利和義行(包括當中的使用條款)，而閣下無權轉讓本協議下閣下的權利和義務。
完整協議:
本協議訂定我們和閣下之間，就有關此協議主題事宜達成的完整理解及協議。
一切條款以英文版本為準。

積分條款及細則

1.會員積分
1.1.所有積分必須為會員本人消費所獲得。
1.2.會員須於交易時向員工索取收據並於完成交易後5日內 (惠顧當日計算在內)掃描收據上的QR CODE 方可儲存積分，否則作廢。
1.3.積分及印花計劃、積分兌換優惠券只適用於參與Chop Stick之商戶。
1.4.會員每消費日最多獲取積分上限為2次，一星期內獲取積分上限10次。
1.5.每次交易只可賺取積分1次，每張收據只可掃描1次。
1.6.會員只須進入應用程式，即可隨時查閱所獲得之積分。
1.7.積分有效期至會員登記後下一年的3月31日至，季度完結日為每年之12月31日 (例如：第1次登記期為2021年3月1日，所有積分會於2022年3月31日完結) 。
1.8.任何過期積分均失效，亦不獲賠償或發還。
1.9.如果Chop Stick懷疑積分是透過欺詐或不誠實的手段獲得，Chop Stick保留權利從其帳戶中扣除積分。

2.積分兌換優惠券
2.1. 會員可於積分有效期內憑有關積分到參與Chop Stick之商戶兌換優惠券。
2.2. 優惠券使用：會員落單時必須向店員出示Chop Stick內相關的版面及會員號碼換領優惠。
2.3. 優惠有效期日期受有關條款及細則約束。
2.4. 優惠確定使用後不可更改，相關之積分亦隨交易被扣除。
2.5. 任何過期優惠券均失效，亦不獲賠償或發還。

3. 其他條款
3.1. 每個會員戶口內積分結餘將以Chop Stick持有的紀錄為決定性證據。
3.2. 會員把食品或服務退回商戶，有關積分會於其帳戶中扣除。
3.3. 如有任何有關積分優惠其他爭議，Chop Stick 保留最終決定權。

GENERAL
By installing the application (defined below), you agree to bound by these terms of use (“Chop Stick Terms”). Please review them carefully before installation and/or acceptance.

DEFINITIONS
“Chop Stick” shall mean the software provided by Chop Stick Limited (“Chop Stick”) to offer services related to the restaurant, to be used on Android or iOS devices and any upgrades from time to time and any other software or documentation which enables the use of Chop Stick.

DATA PROTECTION
Any personal information you supply to Chop Stick when using Chop Stick will be used by Chop Stick in accordance with its Privacy Policy which can be viewed at http://chopstickapp.com/privacy

CHILDREN
Chop Stick is intended for general audiences and does not plan or intend to collect Data from underage below 18. To respect the privacy of underage, underage people below 18 should not provide any Data on Chop Stick. Chop Stick asks that parents or guardians to monitor their children when they surf on the web.

PROPRIETARY RIGHTS AND LICENCE
All trademarks. copyright, database rights and other intellectual property rights of any nature in Chop Stick together with the underlying software code are owned either by Chop Stick or by Chop Stick’s licensors.
Chop Stick hereby grants you a worldwide, non-exclusive, royalty-free revocable license to use Chop Stick for your personal use in accordance with these Chop Stick Terms.

CONDITIONS OF USE
You will not nor will allow third parties on your behalf to (i) make and distribute copies of Chop Stick (ii) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate Chop Stick; or (iii) create derivative works of Chop Stick of any kind whatsoever.
Chop Stick is currently make available to you free of charge for your personal, non-commercial use. Chop Stick reserves the right to amend or withdraw Chop Stick, or charge for the application or service provided to you in accordance with these Chop Stick Terms, at any time and for any reason.
You acknowledge that the terms of agreement with your respective mobile network provider (‘Mobile Provider’) will continue to apply when using Chop Stick. As a result, you may be charged by the Mobile Provider for access to network connection services for the duration of the connection while accessing Chop Stick or any such third party charges. You accept responsibility for any such charges that arise.

SERVICE SUSPEND AND INFORMATION COLLECTION
Chop Stick reserves the right to suspend this service or any parts of the services for repairs, maintenance, upgrades or any other work Chop Stick deems appropriate without prior notice.
Chop Stick will ask users to provide personal information such as telephone and email address for identification or Chop Stick restaurants promotion purposes.

AVAILABILITY
Chop Stick is available to handheld mobile devices running Android or iOS Operating Systems. Chop Stick will use reasonable efforts to make Chop Stick available at all times. However, you acknowledge Chop Stick is provided over the internet and mobile networks and so the quality and availability of Chop Stick may be affected by factors outside Chop Stick’s reasonable control.
Chop Stick and its group of companies and sub-contractors do not accept any responsibility whatsoever for unavailability of Chop Stick, or any difficulty or inability to download or access content or any other communication system failure which may result in Chop Stick being unavailable.
The use of Chop Stick and /or it online queueing features does not provide guarantee of availability of seating.

SYSTEM REQUIREMENTS
In order to use Chop Stick, you are required to have a compatible mobile telephone or handheld device, internet access, and the necessary minimum specifications (‘Software Requirements’).
The Software Requirements are as follows: Android 6.0 or iOS 10 or above.
The version of Chop Stick software may be upgraded from time to time to add support for new functions and services.

TERMINATION
Chop Stick may terminate use of Chop Stick at any time without giving notice of termination to you.

LIMITATION OF LIABILITY
In no event will Chop Stick be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of your use or access to Chop Stick, including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise.
Chop Stick is not liable to you for any damage or alteration to you equipment including but not limited to computer equipment, handheld device or mobile telephones as a result of the installation of use of Chop Stick.
Nothing in these Chop Stick Terms shall exclude or limit Chop Stick’s liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation or any other liability which cannot be excluded or limited under applicable law.

DISCLAIMER OF WARRANTIES
To the maximum extent permitted by law, Chop Stick hereby disclaims all implied warranties with regard to Chop Stick. Chop Stick and software are provided “as is” and “as available” without warranty of any kind.
MISCELLANEOUS
Interpretation of Agreement; Clause headings and examples are provided for reference purposes only to assist in navigating and understanding these Terms and Conditions. They are not intended to define, or limit the scope or extent of any clause.
Governing law: This Agreement shall be governed in all respects by the laws of Hong Kong SAR.
Invalid provisions: If any provision of this Agreement is held to be invalid or unenforceable, that provision shall be struck out and the remaining provision shall be enforced.
No Waiver: Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.
Assignment: We may assign our rights and obligations under this Agreement (including any incorporated Terms and Conditions. You may not assign your rights and obligations under this Agreement).
Entire Agreement: This Agreement sets out the entire understanding and agreement between us with respect to its subject matter.

Coins Terms and Conditions

1. POINTS REWARDS
1.1 All points must be earned by members’ own purchase.
1.2 Receipts will be provided. Members must scan the QR code on the receipt to earn points within 5 days upon purchase completion (including purchasing day).
1.3 Bonus points & food found are applicable to restaurants listed on Chop Stick App.
1.4The quota of earning point is 2 times per transaction date while the weekly quota of earning points is 10 times.
1.5 Points can only be earned per transaction each time. Each receipt can only be scanned once.
1.6 Members can always check their point account balance through login the Chop Stick.
1.7 Points validity period starts from the membership registration date until 31 March of the following year. Quarter end dates will be by 31 December every year. For example, the members’ point expiry date registered on 1 Mar 2021 will be on 31 March 2022.
1.8 Unused points cannot be carried forward and will be expired.
1.9 Chop Stick reserves the right to the deduct points from membership account if we suspect that such bonus points were obtained via fraudulent or dishonest means.

2. REDEEM COUPONS WITH POINTS
2.1 Accumulation and redemption of points are valid only during the point validity period.
2.2 Use of coupon: Members must present the Chop Stick Mobile App interface and membership number to our staff for the offer redemption.
2.3 Coupon offer valid date and specific terms and conditions applied.
2.4 Coupon redemption cannot be canceled or changed once confirmed and the points will be deducted in the system automatically.
2.5 Unused coupons cannot be carried forward and will be expired.

3.OTHERS TERMS AND CONDITIONS
3.1 Records held by Chop Stick shall be treated as conclusive evidence of balance of Points Rewards in each member’s account.
3.2 Points will be credited to your account if you return products or services to restaurants for a refund.
3.3 Chop Stick reserves the rights for any changes and final decision on bonus point offers.
